
After GC sued the defendants for the return of his vehicle and monetary damages, they failed to appear and an inquest (or one-sided hearing on the claim) was conducted. But after the Bronx County Civil Court ended up throwing his case out, an appeal ensued.
On its review of the record, the Appellate Term, First Department, noted that GC’s testimony had “substantial gaps” and “inconsistencies,” and that there was a lack of documentary evidence supporting his claim.
Given his failure to establish a viable cause of action for replevin and money damages related to the alleged wrongful retention of his vehicle, the underlying dismissal was affirmed.
