FIRED PREGNANT WORKER DUE TO “RELIABILITY” CONCERNS
Gracious Bakery + Café, out in New Orleans, Louisiana, was recently sued by the U.S. Equal Employment Opportunity Commission (EEOC) for allegedly firing a pregnant employee.
After the woman reportedly missed two shifts due to a medical emergency related to her pregnancy, she was fired because of “reliability” concerns, given her condition.
Believing that such conduct violated Title VII of the Civil Rights Act of 1964, the EEOC filed suit (EEOC v. Gracious, LLC d/b/a Gracious Bakery + Café), Civil Action No. 24-cv-00218) in the U.S. District Court for the Eastern District of Louisiana seeking monetary damages and injunctive relief.
In a written statement, Rudy Sustaita, regional attorney for the EEOC’s Houston District Office. Noted that, “A pregnant worker is protected against discrimination by federal law …. An employer who acts on harmful stereotypes about a pregnant worker’s reliability violates the law.”
