HER APPEAL WAS ACADEMIC

DISMISSED BECAUSE SENTENCE HAD BEEN SERVED

After the City Court of Middletown (Orange County) convicted her of “criminal possession of a controlled substance in the seventh degree,” AW appealed.

Apparently, AW had agreed to a plea deal wherein she was to participate in a drug-treatment program or suffer up to a year in prison. And because she failed to honor the terms of that arrangement, she ended up getting sentenced to 364 days (together with a separate 90-day term in a different matter).

But since she had already completed her prison term by the time her appeal was heard, the Appellate Term, Second Department, ultimately ended up dismissing the matter because it considered her challenge to be “academic.”

I guess you could say she graduated ....
