WHEELER TRUCKING WHEELS IN DISCRIMINATION CLAIM

COMPANY AGREES TO PAY $65,000

Wheeler Trucking, Inc. and Wheeler Logistics, Inc. – companies engaged in automative hauling and “logistics” – were sued by the Equal Employment Opportunity Commission (EEOC) for race and religion-based discrimination.

In addition to comparing a Jewish employee to a “terrorist,” and mocking his religious beliefs, he was wrongfully denied the ability to have Saturdays off (so that he could observe the Sabbath).

Believing that such conducted violated Title VII of the Civil Rights Act of 1964 (Title VII), the EEOC filed a lawsuit against Wheeler in U.S. District Court for the Northern District of Ohio Eastern Division (EEOC v. Wheeler Trucking, et al., 1:23-cv-01874), seeking monetary damages and injunctive relief.

In addition to paying $65,000, the companies agreed to modify their employment related policies and practices.

By way of a written statement, Philadelphia District Office Regional Attorney Debra Lawrence noted that, “Employers that fail to correct and prevent harassment must be held accountable …. The EEOC is committed to remedying and preventing harassment because of race and religion and to ensuring that employers do not retaliate against workers because they engage in protected activity.”
