WAS THIS WISE OF WEIS MARKETS?

SETTLES “SEXUALLY HOSTILE WORK ENVIRONMENT” CASE FOR $75,000

Because it allegedly subjected a female employee to a “sexually hostile work environment,” at it Mifflintown, Pennsylvania, store, the U.S. Equal Employment Opportunity Commission (EEOC) filed suit against Weis Markets, Inc., under Title VII of the Civil Rights Act of 1964 (Title VII), and Titles I and V of the Americans with Disabilities Act of 1990 (ADA), U.S. EEOC v. Weis Markets, Inc., Civil Action No. 1:23-cv-01767, in U.S. District Court for the Middle District of Pennsylvania (Harrisburg), seeking monetary damages and injunctive relief.

Apparently, in addition to failing to take appropriate responsive to the alleged “unwanted physical contact and sexual comments,” the company required the victim to participate in a program which would have included mental health counseling. And was fired when she refused to cooperate.

In a press release dated June 18, 2024, the EEOC announced that in addition to a $75,000 monetary payment to the impacted individual, the company has agreed to modify its employment related policies and practices and will refrain from subjecting employees to “unlawful medical examinations or disability-related inquiries.”

By way of a written statement, EEOC Regional Attorney Debra Lawrence noted that, “The EEOC commends Weis Markets for working cooperatively and in good faith with the EEOC to find an appropriate resolution of this case …. This settlement provides fair compensation to the aggrieved employee in question, and going forward, it also promises to greatly benefit Weis Markets’ workers, the company, and the public interest.”

No little piggies will be working at that market …..
