TULARE SCHOOL DISTRICT ENGAGED IN NATIONAL ORIGIN DISCRIMINATION

REQUIRED TO PAY VICTIM $45K

Alleging that the Tulare City School District failed to promote him on the basis of his Hispanic national origin, the U.S. Equal Employment Opportunity Commission (EEOC) filed a federal charge alleging violations of Title VII of the Civil Rights Act of 1964.

In a recently announced settlement, without conceding liability, the School District agreed to paying the impacted individual $45,000 and will implement changes to its employment practices – which will include supervisor and manager trainings, and notifying all employees of their rights under federal anti-discrimination law.

In a writing statement, Armando Hernandez, director of the EEOC’s Fresno local office, noted that, “It is imperative that employers put in place objective measures during the hiring process in order to prevent subjective and unintentional biases that may negatively impact the selection process …. We commend the Tulare City School District for resolving this charge, recognizing areas for improvement, and putting in place training measures that will benefit employees throughout the school district.”
