NO INCREASED CHILD SUPPORT WITHOUT A HEARING

GIVEN CONFLICTING SUBMISSIONS, OUTCOME WASN’T PROPERLY SUPPORTED

When AF sought to increase SF’s child support obligations, the Rockland County Supreme Court granted AF’s request and increased the monthly payment from $1282.53 to $1375.

On appeal, the Appellate Division, Second Department, had an issue with that outcome.

Apparently, the court below set the amount without a hearing, and failed to provide “any findings or a sufficient calculation of child care expenses on the record.”

Given the parties’ conflicting submissions and contentions, the AD2 thought that a proper evidentiary hearing was needed and sent the matter back for a new determination.

That’s a lot of work for $92.47.
