DIDN’T ADHERE TO MEDICATION REGIMEN; SHOWED NO SIGNS OF IMPROVEMENT
After the Bronx County Supreme Court found she had permanently neglected her child and terminated her “parental rights,” the mother appealed to the Appellate Division, First Department.
On its review, the AD1 thought that the petitioning agency “fulfilled its statutory duty” and that it had endeavored to improve the mother’s relationship with the child, to no avail.
Apparently, the mother was suffering from some mental health issues, and neither her condition nor parenting skills improved, despite the agency’s active monitoring and its referral services. Among other things, the mother failed to adhere to a medical treatment regimen and showed no signs of improvement despite undergoing therapy and participating in other services. By way of example, she is said to have engaged in “disruptive conduct,” which caused many of her parental visits to end prematurely or be canceled.
Given that backdrop, the AD1 could discern no irregularity and left the outcome undisturbed.
