J&M PAYS $150,000 TO SETTLE AGE DISCRIMINATION CLAIM

COMPANY REPLACED HER WITH A MAN IN HIS 30s

A Ponchatoula, Louisiana, company by the name of J&M Industries, Inc., was accused of violating federal law when it fired a senior employee who refused to retire when she reached 65-years-of-age. In response to the news, the company informed the purchasing agent that her position was being eliminated due to economic uncertainty. Yet, a month later, the company hired a man in his 30s for the same position.

Alleging violation of the Age Discrimination in Employment Act (ADEA),the U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit (EEOC v. J&M Industries, Inc., Civil Action No. 2:23-cv-01100) in the U.S. District Court for the Eastern District of Louisiana. In a recently announced settlement of that case, in addition to paying the impacted individual $105,000 in back pay and liquidated damages, J&M has agree to modify its training and employment related policies and practices and to post a notice regarding its obligations under the ADEA.

In a written statement, Rudy Sustaita, regional attorney for the EEOC’s Houston District Office, noted that “This resolution serves the public interest …. It provides relief for the former employee and will help protect others from age discrimination. We are pleased that the EEOC and J&M Industries were able to reach this resolution.”

Looks like they sure got over that hill there ….
