COMPANY WOULDN’T HIRE A GUY WHO HAD ADHD AND TOOK ADDERALL

Eagle Marine Service Electrical and Refrigeration, a marine services company based out of Berwick, Louisiana, is said to have rejected a job applicant whose medical testing revealed he had ADHD (attention deficit hyperactivity disorder) and took Adderall for treatment.

Because such a decision was believed to violate the Americans with Disabilities Act (ADA), the U.S. Equal Employment Opportunity Commission (EEOC) filed suit in U.S. District Court for the Eastern District of Louisiana (Civil Action No. 3:22-cv-00676), seeking monetary damages and injunctive relief.

In a recently announced settlement, the company agreed to pay the impacted individual some $45,000 and will modify its employment and training related practices.

By way of an accompanying written statement, Rudy Sustaita, regional attorney for the EEOC’s Houston District Office noted that, “This resolution provides appropriate relief for the former applicant and sends the message that employers are obligated to assess and hire individuals with disabilities in accordance with the law.”
