NONCOMPLIANCE WITH COURT’S (MULTIPLE) ORDERS WARRANTED ARREST
After the New York County Supreme Court issued a warrant for his arrest, VS appealed.
On its review of the record, the Appellate Division, First Department, noted that there had been multiple court orders, dating back to February 2021, wherein VS was directed to transfer certain shares of stock, held by Dolfin Financial to plaintiff DS, but failed to comply.
Despite multiple opportunities to relinquish the shares, the defendants claimed that Dolfin’s financial insolvency prevented defendants from effectuating the transfer. But because that position wasn’t competently supported – as defendants only submitted “inadmissible hearsay and questionable documents” – the AD1 thought the issuance of the arrest warrant “was appropriate” under the circumstances.
