Parents Cry Foul After Robert Dungan, Owner of Big League Pics, Allegedly Pocketed Thousands of Dollars for Niskayuna Baseball and Softball League Photos But Failed to Deliver Them

Suit Seeks Permanent Injunction; Restitution and Penalties

Attorney General Eric T. Schneiderman recently announced a lawsuit filed in Albany County Supreme Court gainst GND Studios, LLC, a photography studio operating as Big League Pics, and its owner, Robert Dungan, for allegedly failing to deliver photographs to hundreds of parents of youth baseball and softball players who had purchased photography packages. The lawsuit alleges that Dungan photographed the leagues’ teams and individual players in May 2017 pursuant to a contract with the Niskayuna Baseball League and the Niskayuna Softball League and collected thousands of dollars from parents for a variety of photography packages ranging in price from approximately $18 to $49. Dungan then failed to deliver the photographs or make refunds to consumers.

“New Yorkers spent their hard-earned money to have a keepsake of their children’s baseball and softball experiences. Parents were right to cry foul when Big League Pics allegedly didn’t deliver – and my office will seek to hold the company responsible for depriving parents of both their dollars and their memories,” said Attorney General Schneiderman.

According to papers filed in Albany Supreme Court, after GND Studios failed to deliver the photographs, league officials, other parents, and a representative from the Attorney General’s Office all reached out to Dungan by telephone, e-mail, and mail, urging him to deliver the photos or issue refunds. Despite several assurances that he would do so, Dungan allegedly never delivered the photographs. The lawsuit seeks restitution, costs, and penalties. The lawsuit also seeks a permanent injunction against the respondents engaging in the photography business within the State of New York until they file a $25,000 performance bond.

This investigation is being handled by Assistant Attorneys General Emily Auletta and Amy Schallop, with assistance from Senior Consumer Frauds Representative John Van Voris and Investigator Mark Rudd, under the supervision of Deputy Bureau Chief Laura J. Levine and Bureau Chief Jane M. Azia of the Consumer Frauds and Protection Bureau. The Consumer Frauds and Protection Bureau is overseen by Executive Deputy Attorney General for Economic Justice Manisha Sheth.
