Even though another broker was listed in the underlying contract of sale, Talk of the Town Realty sued Mario Geneve to recover a commission, because one of the company's brokers--Simon Yermash--had shown the property to the eventual purchasers.
While the Kings County Supreme Court didn't think that Talk had a case, the Appellate Division, Second Department, was of the view that there were unresolved questions as to whether Yermash was "the procuring cause of the sale" and whether there was "a direct and proximate link … between the bare introduction and the [deal's] consummation."
