THE LESSER OF TWO EVILS?

Jean Walton Leser sued for "libel," because offensive remarks and "pornographic" images (allegedly involving her) appeared on Christopher Penido's website.

Since the materials falsely portrayed the woman in a promiscuous light, and there was no doubt that Penido was the one who posted them, both the New York County Supreme Court and the Appellate Division, First Department, were of the view that Penido was liable for "libel per se" and that Lesser was entitled to compensatory and punitive damages, as well as her attorneys' fees.
