In 2010, when Kelly Herr filed for divorce, she wanted to have a prenup nullified.
While the Madison County Supreme Court thought that Kelly hadn't fully appreciated all of the agreement's provisions, and found the terms to be "unconscionable"--the Appellate Division, Third Department, concluded otherwise. The AD3 was of the view that the court below "erroneously interpreted" the document and that Kelly's own testimony had established that she fully understood what she was waiving.
