After a hearing, the New York County Family Court issued an order back in January 2024 granting F.D. permission to obtain a passport for her child and to travel with the youngster to Benin, without the consent of A.D.
An appeal followed.
But by the time A.D.’s challenge got to the Appellate Division, First Department, the travel period covered by the order had already passed, FD had successfully obtained the passport, traveled to Benin with the child, and returned safely in February 2024.
Given those developments, the AD1 dismissed the appeal as “moot.”
