FAILED TO SHOW THAT DEFENDANT CAUSED HER EYE CONDITION
After her “restitution” claim for damages allegedly caused by MGE was denied by the New York County Family Court, OM appealed.
And on its review of the record, the Appellate Division, First Department, noted that OM not only failed to show that MGE caused her eye condition, but she neglected to present any evidence that she sought treatment and that costs were incurred.
Given that backdrop the denial of relief in her favor was “unanimously affirmed.”
