COMPANY AGREES TO PAY $200,000 TO RESOLVE FALSE CLAIMS ACT ALLEGATIONS

A Kentucky medical equipment supplier, known as Oxygen Plus, Inc., recently agreed to resolve a False Claims Act claim brought against the company for $200,000.

From 2017 to 2021, the company allegedly submitted some 300 false claims to Medicare and Medicaid for respiratory devices, called non-invasive ventilators, that patients “did not need or use.”

The devices, designed to deliver pressurized air into the lungs of patients with respiratory diseases, are paid for by federal health insurance programs so long as they are “necessary and reasonable” for a patient’s treatment.

According to a press release issued by the US Attorneys Office, the lawsuit was brought by two former employees of the company under the “qui tam, or whistleblower, provision of the False Claims Act.” And those individuals will share $32,000 of the settlement proceeds.
