When Wells Fargo Bank started a foreclosure case, the Suffolk County Supreme Court granted relief in the bank’s favor, but--on appeal--the Appellate Division, Second Department, reversed.

Apparently, the bank couldn’t establish that the underlying note was in its possession at the time the case had been initiated. The bank also failed to submit an affidavit of service showing that it had properly served the defendants pursuant to state law--RPAPL 1304.

That didn’t go so Wells.
